Terms of Service
These terms ("Terms") form the agreement between you and Wend ("we", "us", "our") whenever you use the Wend mobile app, the website at wendapp.co, or any related service we provide. They are written to be read. Please read them.
1 · Who you're contracting with
Wend is operated by [LEGAL_ENTITY_NAME], registered at [REGISTERED_ADDRESS], Ireland. Throughout these Terms, "Wend" means that entity.
2 · Accepting these Terms
By installing, opening, signing into, or otherwise using Wend, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you don't agree, please don't use Wend — uninstall the app and stop visiting the website.
3 · Eligibility
You must be at least 16 years old to use Wend. If you're under 16, please don't create an account or post community content. If you're between 16 and the age of legal majority where you live, you confirm that a parent or legal guardian is aware of and consents to your use of Wend.
4 · Your account
- You sign in using Sign in with Apple. You're responsible for keeping your Apple ID and the device it lives on secure.
- One account per person. You may not share an account or transfer it to anyone else.
- You're responsible for activity that takes place under your account, except where caused by our negligence or breach of these Terms.
- If you suspect unauthorised access, contact us at hello@wendapp.co and revoke Sign-in-with-Apple access in iOS Settings → Apple ID → Sign-in & Security.
5 · Your licence to use Wend
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Wend on devices you own or control, for non-commercial use. We retain all other rights. You don't get any ownership in the app, the website, the brand, or our editorial content — only the right to use it as described here.
6 · What you can't do
- Reverse-engineer, decompile, or attempt to derive source code from Wend, except where the law gives you that right and we can't lawfully exclude it.
- Resell, sublicense, or commercially exploit Wend or its content.
- Scrape, crawl, or systematically extract content from the app or website using automated means.
- Interfere with the operation of Wend, the integrity of our backend, or the security of other users.
- Use Wend to break the law, violate someone's rights, or do anything we'd reasonably consider hostile to other users.
- Misrepresent your identity — including impersonating a curator, a Wend employee, or another user.
7 · Editorial content vs. user content
Wend contains editorial content we've written or commissioned (destination guides, trail routes, eat picks, money guides, health-and-safety notes), and user content you post (community tips, journals, journal entries, photos).
7.1 Our editorial content
Editorial content is owned by Wend or licensed to Wend. You may use it inside the app for your own travel. You may not republish, redistribute, or use it to train machine-learning models without our written permission.
7.2 Your content
You keep ownership of everything you post. By posting, you grant Wend a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, display, distribute and translate your content for the limited purpose of operating, promoting, and improving Wend. This licence ends when you delete the content, except for backups and copies cached at our content-delivery-network edge, which expire within 30 days.
You agree that anything you post:
- Is yours to share — you wrote it, took the photo, or have all necessary permissions.
- Doesn't infringe anyone's copyright, trademark, privacy, or other rights.
- Isn't defamatory, threatening, harassing, hateful, sexually explicit, deceptive, or illegal.
- Doesn't contain personal data about other identifiable people (faces, names, addresses) without their permission.
- Doesn't include affiliate, sponsored, or paid placements without clear disclosure.
We may, but are not obliged to, review or moderate user content. We can remove content or suspend accounts that breach these Terms or our community guidelines (in-app). Where required, we will follow Article 14 of the EU Digital Services Act and notify you of any moderation action.
8 · Affiliate links and bookings
Wend recommends transport, accommodation and flight partners (currently 12Go, Hostelworld, Booking.com, Kiwi.com, Skyscanner and Rome2Rio). When you tap one of those CTAs, you leave Wend and your booking is handled directly by that partner under their terms and privacy policy. We earn a commission on bookings you complete via those links.
- We are not a travel agent or a tour operator. Bookings are between you and the partner. Refunds, cancellations, schedule changes and disputes are governed by the partner's policy.
- Commission does not change what you pay. Pricing on the partner's site is identical whether you arrive via Wend or directly.
- We don't get paid more for recommending one partner over another. Our editorial choices are not pay-to-play.
9 · Travel information — accuracy and your responsibility
Wend is an editorial travel companion. We curate routes, prices, opening hours, visa snapshots, transport options and safety advisories from trusted sources, but the world changes faster than any guidebook. You are responsible for verifying anything that materially affects your trip — visas, vaccinations, border crossings, currency, prices, opening hours, and conditions on the ground — with primary sources before relying on it.
Wend's content is not legal, medical, immigration, financial or insurance advice. The Visa Checker, Health & Safety guide, and Money guide inside the app are convenience summaries, not authoritative determinations. Always check official government sources (your passport country's foreign ministry, your destination's embassy, the relevant immigration service) before you travel.
10 · Pricing
Wend is currently free to download and use on iOS. Some optional features may be paid in future; if and when that happens, prices and the exact paid scope will be shown clearly inside the app and you'll never be charged without a separate, explicit confirmation. Apple's standard refund process (App Store → Report a Problem) applies to in-app purchases.
11 · Service availability and changes
We aim to keep Wend available, but we don't guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue any part of Wend at any time, with or without notice, although we will give you reasonable advance notice for material changes that affect features you actively rely on.
12 · Termination
You can stop using Wend at any time. To remove your data as well, use Profile → Account → Delete account in-app, which deletes your account and all linked records as described in our Privacy Policy.
We can suspend or terminate your access to Wend if you materially breach these Terms, if your account is dormant for an extended period, if we are legally required to, or if continuing to provide service to you would expose us or other users to undue risk. Unless the breach is severe, we will give you reasonable notice and a chance to put things right first. Sections 5–10, 13, 14, 16 and 17 survive any termination.
13 · Disclaimers
Wend is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties — express, implied or statutory — including the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of content. We do not warrant that Wend will be uninterrupted, error-free, or that any specific destination, route, price or opening hour will be correct at the moment you act on it.
Nothing in these Terms limits or excludes any rights you have as a consumer that cannot be waived under the law of your country of habitual residence — including Irish and EU consumer protection law.
14 · Limitation of liability
To the extent allowed by law:
- Wend will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, data, goodwill, or business opportunities, arising out of your use of (or inability to use) Wend.
- Our total aggregate liability to you for all claims arising in any 12-month period will not exceed the greater of (a) the amount you paid Wend in that period, or (b) €100.
Nothing in this section limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; gross negligence or wilful misconduct; or any liability that cannot be limited or excluded under applicable law.
15 · Indemnity
You agree to indemnify and hold Wend harmless from claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of (a) your breach of these Terms, (b) content you post that infringes someone's rights, or (c) your misuse of Wend. We will tell you promptly of any claim and let you control the defence (subject to our consent on settlements that affect us).
16 · Governing law and venue
These Terms are governed by the laws of Ireland, without regard to conflict-of-laws rules. Disputes will be heard in the courts of Ireland on a non-exclusive basis. If you are a consumer resident in the European Economic Area, you have the right to bring proceedings in your country of residence and to rely on mandatory provisions of that country's law that cannot be derogated from by agreement.
The European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr. We are not currently obliged to participate in alternative dispute resolution but will consider any complaint sent to hello@wendapp.co in good faith.
17 · Apple-specific terms
If you downloaded Wend from the Apple App Store, the following also apply, in addition to (and without limiting) anything else here:
- These Terms are between you and Wend, not between you and Apple. Apple is not responsible for Wend or its content.
- Apple has no obligation to provide maintenance or support for Wend.
- If Wend fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation in respect of Wend.
- Apple is not responsible for addressing claims by you or any third party relating to Wend or your use of it, including (a) product liability claims, (b) any claim that Wend fails to conform to legal or regulatory requirements, or (c) claims arising under consumer protection or similar legislation.
- Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms with the right to enforce them against you.
18 · Changes to these Terms
We can update these Terms. If we make material changes, we will notify you in-app and update the "Last updated" date at the top of this page. Your continued use of Wend after a change takes effect means you accept the new Terms. If you don't accept, please stop using Wend.
19 · General
- Entire agreement. These Terms (with our Privacy Policy and any notices we display in-app) are the entire agreement between you and Wend, and supersede prior agreements on the same subject.
- Severability. If any provision is found unenforceable, the rest still applies.
- No waiver. If we don't enforce a right, that's not a waiver of it.
- Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or successor in connection with a merger, acquisition, or sale of substantially all of our assets, on at least the same protections set out here.
- Force majeure. Neither party is liable for failure to perform caused by events beyond reasonable control.
- Notices to us must be sent to hello@wendapp.co. Notices to you may be sent in-app or by email to the address linked to your account (including any Apple Hide-My-Email relay).
